The Spanish Language

The Spanish language, due to its global importance, is one everyone knows a few words from whether if it is just hola or adios. However if you heard somebody talking about a language called "Castilian", what language would you think they were referring to? You would be forgiven for believing that they were referring to some little spoken dialect rather than the language that most people refer to as 'espanol'. Although people talk about the Spanish language, in actual fact there are many Spanish languages and of these, the official tongue is Castilian. Those who have developed an interest in the Spanish language realise that it is extremely intricate and varied according to where it is being spoken, not only in terms of continent, but also in terms of country.

When we hear Spanish referred to one of the Romance Languages, great images are instantly conjured up of the Spanish Conquest, Juan Carlos or even just sunny weather and idyllic landscapes, but what the phrase actually reveals is that Spanish is a language derived from Latin, and so shares some similarities in terms of grammar and vocabulary with other popular European languages such as French and Italian. It also reveals the fact that the language can be traced all the way back to the reign of the Roman Empire, and indeed, a brief reflection on the origins of the language takes us back almost 2,000 years when the beginnings of the language commonly recognised as Spanish began to take shape on the Iberian Peninsula. The only common feature of the Spanish language which can be solely attributed to Spain itself rather than to Rome is the character, which was probably developed by scribes as a shorthand way of writing a double n, and signifies that the n is to be rolled off the tongue in speech. For example, the Latin word annus' (year) Spanish equivalent is aos, and is pronounced 'an-yos'.

Nowadays, as well as Castilian, the Basque, Catalan and Galician languages are also frequently used in Spain. Those who speak these languages are reluctant to call them dialects because the term suggests some form of dependence on Spanish. Instead, they are recognised as languages in their own rights and the use of these different languages reflects distinct and sometimes much divided Spanish cultures. For example, in the Basque region of Spain, there are ongoing campaigns for independence and so the fierce protection of the language constitutes a significant symbol of the Basque people's ongoing plight. The Spanish language and its variations are not only contained to Spain itself, but as a result of the Spanish Conquest have been spread all over the world, notably across the Atlantic Ocean to Latin America where Spanish is spoken in Argentina, Mexico, Nicaragua, Honduras, and many more countries. Over 300 million people in the world today speak Spanish as their native language, although it is becoming more and more evident that English is invading the Spanish language, just as it has done to French recently. Buzz words and slang terminology are regularly found in Spain and Latin America, interjected into fast Spanish speech. To use just a few examples, the words 'bus stop,' 'marketing' and 'click' are now all widely used in the Spanish language, with the resulting mish-mash of words being branded as 'Spanglish.' People who take pride in the Spanish language are keen to limit the ways in which English is infiltrating their mother tongue, although whether the Spanish take the same extreme measures as recently seen in France in order to protect the quality of their language remains to be seen.

In terms of learning the language, it is often marketed in schools as being one of the easiest languages to pick up, mainly due to its natural rhythm and flow of words, for example the fact that as a general rule you are able to determine whether a noun is masculine or feminine by checking to see whether it ends in 'o' or 'a.' But the language is not without its complexities. For example, one of the first things students have to get to grips with is when to use the verb 'ser' and when to use the verb 'estar.' A quick look in the dictionary will confirm that both these verbs are defined as 'to be,' but 'estar' is used for temporary states, and 'ser' is used when a condition is permanent. For example, if I were to be describing my gender I would conjugate 'ser' and say "soy una chica" (note the feminine word's 'a' ending), whereas if I were to describe my mood I would use estar and say "estoy muy contenta" because a mood is likely to change over time. Spanish pronunciation is relatively easy, because you pronounce the letters you see. It must be noted however, that exact pronunciation depends on which part of the world you are in, and two native Spanish speakers can sound very different from one another. The benefit of learning to play acoustic guitar is that you can practice anywhere - and you are going to be practicing a lot! You are not restricted to being close to an amplifier socket, but apart from that there is not all that much difference between learning acoustic and electric guitar.

The most important thing you must do is to make sure that your guitar is properly tuned. Invest in a set of pitch pipes or tuning forks, and learn how to get each string exactly in tune. If not, then you will never develop an 'ear' for your strings and their pitch. There are lots of sites online that explain how to properly tune your instrument - and remember that the guitar is a musical instrument and not a toy.

A good tip right at the start is to begin strengthening your grip: you can do this any way that suits you but there are inexpensive grip strengtheners available that you can use daily. Along with this, you will have to develop calluses on your fingertips, and while that will be painful for a time you can help it along by rubbing some surgical spirit in to them. All good players go through this, so don't think you are damaging your fingers when the pain starts - it is normal.

Get to know your instrument. Learn what the various components are and what their function is, and check out how the tension and length of your strings change the tone. Practice with steel and nylon strings, and use those that give you the sound that you want. The same is true of your pick, or plectrum. The more you practice the more you will learn, and once you have mastered a few of the essential chords you should start to learn about keys and a little about the theory of music. This will help you when you begin to practice the more difficult and advanced pieces.

If you are finding it hard to play a particular piece, or even a particular chord such as barre chords that most people find difficult to finger correctly when they first try, keep at it. Keep practicing the difficult stuff and it will eventually come to you. You will never get anywhere if you give up on the difficult and stick to the easy. You will also find it easier to get started learning to play acoustic guitar if you have a buddy learning with you. Or perhaps they are learning bass and you acoustic - you could jam together at least once a week to lighten up once in a while.

Learning acoustic guitar should be fun, and you will have more fun playing along with somebody else than just by yourself. That's also why you should practice with tunes you like, rather than just those that happen to be in the learning book you are using. If you can't find a book with your tunes then look on the internet. You will find standard sheet music and guitar tab, and you can try both if you want. You will be a more accomplished player if you understand how to read music, but it is not essential. You can play without.

Finally, a few words on purchasing your first guitar. If you aren't sure whether or not you want to play seriously, buy a cheap guitar at first. There's no point in wasting money. However, once you find that this is what you want to do, then get the best you can possibly afford. There are no doubts at all that with guitars, money buys quality.

There is not a single piece of evidence that can be reliably and independently traced back earlier than the eleventh century. The professional historians faint as prominent mathematician Doctor Fomenko et al research the known historical data and come to fairly controversial conclusions. For example, the English historians rage at the suggestion that the history of Ancient England was de facto a Byzantine import transplanted to the English soil by the fugitive Byzantine nobility. As the sign of recognition of the special role of the English historians who consider themselves the true scribes of World History, the cover of the present book portrays Tintoretto's Jesus Christ crucified on the Big Ben. The Russian historians brand it as pseudoscience because Dr Fomenko asserts that there was no such thing as the Tartar and Mongol invasion followed by over two centuries of slavery, providing a formidable body of documental evidence to prove his assertion. The so-called `Tartars and Mongols' were the actual ancestors of the modern Russians, living in a trilingual state and aspiring Global Empire with Arabic and Turkic spoken as freely as Russian. The ancient proto-Russian state was governed by a double structure of civil and military authorities and the hordes were actually professional armies with a tradition of lifelong conscription (the recruitment being the so-called `blood tax'). Their `invasions' were punitive operations against the regions that attempted tax evasion. Fomenko proves for a fact that official Russian history is a blatant forgery concocted by a host of German scholars brought to Russia by the usurper dynasty of the Romanovs. Their ascension to the throne was the result of conspiracy, so they charged these German historians-imports with the noble mission of making Romanov's reign look legitimate. Dr Fomenko et al prove Ivan the Terrible to be a collation of four rulers, no less. These rulers represented the two rival dynasties - the legitimate Godounovs and the ambitious Romanov upstarts. The European historians fume not only because Fomenko blows consensual Russian history to smithereens, successfully removing a crucial cornerstone from underneath the otherwise impeccable edifice of World History but for asserting that all medieval European Kings and Princes were but breakaway vice-regents and vassals of the Global Empire who badly needed glorious and very `ancient' past in order to legitimize their new independence from the Empire. Dr Fomenko adds insult to injury, wiping out one by one: the Ancient Rome: the foundation of Rome in Italy is dated to the 14th century A. D., the Ancient Greece and its numerous poleis, which he identifies as the mediaeval crusader settlements on the territory of Greece, the Ancient Egypt: the pyramids of Giza become dated to the 11th to 14th century A. D. and identified as the royal cemetery of the Global Empire, no less. The civilization of the `ancient'' Egypt is irrefutably dated to the 11th to 15th century A. D. following the breakthrough in decoding of the ancient Egyptian horoscopes cut in stone and painted on the temple walls. Arabic historians may find some consolation in the crucial historical role of the Ottoman Empire as a part of the Global empire in the 15th - 17th century. The trouble is that this Empire was initially a proto-Christian state, with Hagia Sophia identifiable as Temple of Solomon, but built in 1550-1557 A.D. by Sultan Suleiman according to Fomenko and Islam with all its key figures is datable to 15th 16th century A. D.! The Chinese historians are also an unhappy lot because Fomenko wipes out the Ancient History of China outright. No such history. Period. The compilation of the so-called Ancient Chinese History is reliably datable to the 17th 18th century only. It is perfectly recognizable as the Ancient European history, reworked and transcribed in hieroglyphs as yet another historical transplantation. The Divinity excommunicates Dr Fomenko because the history of religions according to Fomenko looks as follows: the pre-Christian period (before the 11th century and Jesus Christ ), Bacchic Christianity (11th to 12th century, before and after Jesus Christ), Jesus Christ Christianity (12th to 14th century) and its subsequent mutations (15th to 17th cy) into Orthodox Christianity, the Catholicism, Protestantism, Islam, Buddhism, and so on..; and The Old Testament written after the New Testament in xiv-xvi cy A.D., if you please! Everybody served? Saint Augustine was quite prescient when he said: "be wary of mathematicians, particularly when they speak the truth."

Did events and eras such as the crucifixion of Jesus Christ, the Roman Empire , the Dark Ages, and the Renaissance, actually occur within a very different chronology from what we've been told? Yes, they certainly did! The history of humankind is both drastically shorter and dramatically different than generally presumed. Why is it so? On one hand, it was usual custom to justify the claims to title and land by age and ancestry, and on the other the court historians knew only too well how to please their masters. The so called universal classic world history is a pack of intricate lies for all events prior to the 16th century. World history as we learn it today was entirely fabricated in the 16th-18th centuries. It's likely that nobody told you before, but there is not a single piece of firm written evidence or artefact that is reliably and independently dated prior to the 11th century. Naturally, after what you've learned in school and university, you will not easily believe that the classical history of ancient Rome, Greece, Asia, Egypt, China, Japan, India, etc., is manifestly false. You will point accusing finger to the pyramids in Egypt, to the Coliseum in Rome and Great Wall of China etc., and claim, aren't they really ancient, thousands of years ancient? Well, there is no valid scientific proof that they are older than 1000 years! The oldest original written document that can be reliably dated belongs to the 11th century! New research asserts that Homo sapiens invented writing (including hieroglyphics) only 1000 years ago. Once invented, writing skills were immediately and irreversibly put to the use of ruling powers and science. The consensual chronology we live with was essentially crafted in the 16th century by the Jesuits. The world history was compiled from contradictory mix of innumerable copies of ancient Latin and Greek manuscripts and other irrefutable proofs delivered by late mediaeval astronomers that were cemented by the authority of writings of the Church Fathers. Early in life, we learn about ancient history. Children love the magical lessons of history - they are like fairy tales. Teachers recite breathtaking stories; very soon We learn by heart the names and deeds of brave warriors, wise philosophers, fabulous pharaohs, cunning high priests and greedy scribes. We learn of gigantic pyramids and sinister castles, kings and queens, dukes and barons, powerful heroes and beautiful ladies, emaciated saints and low-life traitors. Ancient history is based documents, manuscripts, printed books, paintings, monuments and artefacts - called primary sources. The problem is that neither these ancient documents, nor events described therein can be irrefutably dated, moreover they contradict each other for the most part. When a school textbook tells us that Genghis Khan in year X or Alexander in year Y, have each conquered half of the world, it means only that it is so said in some of the written sources. There are no answers to simple questions: When were these primary sources written? Where and by whom were these sources found? It is wrongly presumed that ancient and medieval chronicles, written by Genghis Khan's or Alexander the Great contemporaries and eyewitnesses, are readily available. Actually, only sources written hundreds or even thousands of years after the events are there, compiled mostly in the 16th 18th centuries, or even later. As a rule, these sources suffered considerable multiple manipulations, falsifications and distortions by editing. At the same time, innumerable originals of ancient documents under various pretexts were destroyed in Europe under various pretexts. The names of persons and geographical sites often changed meaning and location during the course of the centuries. Geographical locations became clearly defined on maps only with the advent of printing. This made possible the circulation of identical copies of the same map for purposes of the military, navigation, education and governance tasks. Historians from Oxford say: "hey, everybody knows that Julius Caesar lived in the first century B.C. `Julius Caesar' statement is only a point of view as there is simply no irrefutable documentary proof that Julius Caesar or any other great name of antiquity ever existed. Better than that - extremely rare sources that can be reliably dated back to the 10th-14th centuries A D, do not show the polished picture of classical history. They show a picture both contradictory and confusing. All methods of dating of ancient sources and artefacts are erroneous: Radio-carbon C14 method produces dating with exactitude of plus minus 1500 years, therefore it is too crude for dating of events in historical timeframe! The Almagest tractate, which lies as corner stone contemporary chronology, compiled in the 2nd century A D by Ptolemy, the founding father of astronomy, contains astronomical data of 9th to 16th century! The Bronze Age,that has supposedly began 5000 years ago. Bronze is made of 90% copper and 10% tin, but the technology for tin extraction dates back to 14th century A D!. All eclipses contained in manuscripts, like Thucydides one, relating 'ancient' events have exclusively medieval dating. All horoscopes cut in stone or painted in Egyptian temples, like Dendera have exclusively early medieval dating solutions. Not quite what you have learned in school? Open your eyes, and, you will find sufficient proof to reach step by step the inevitable conclusion that the classical chronology is false and therefore, that the history of ancient and medieval world universally accepted today, is also false. Have a fresh outlook on everything said or printed about "ancient" and "enigmatic" Roman, Greek and Egyptian, medieval as well as all other "lost and found" civilizations. Antiquity and Dark Ages are phantoms invented in the 16th 18th and polished in 19th 20thcenturies. Human civilization is in fact barely 1000 years old! This book will change your perception of History forever! What if Ancient Rome, Greece and Egypt were invented during Renaissance? It had been a glorious sunset on the mountains. One of those days when majesty and glory seem to be in the fresh scarlet lit air. It was a day for discovery and I wanted to find some new music, a new band to listen to and share with my friends. I went to that awe-inspiring compendium of video on the web YouTube to try and find some new Independent Music groups. To my amazement I found nothing but the big major label brand names that are everywhere anyway. I wanted to find new music! What's a body to do?

I realized as quickly as the winter's night closed the last sunset there was a problem. With days of work I could find a few interesting groups on YouTube, but quite frankly, the picking is very slim and I know there is a lot of good music waiting out there. Look, that is what you need to think about, look and be seen. You have to be seen to be heard and music video is the way to do that.

The first goal is to get you musicians to create more videos from your already existing tracks. My next goal is to point you in a direction where you can be easily found.

A good place to get images and film clips that are public domain, for your new impressive video production, is the Internet Archive at http://www.archive.org/details/movies. There should be plenty there for you to work with and get your music ready to be seen. I have not only pointed many a band to this treasure trove of clips but have seen the extraordinary videos that have been fashioned out of them.

If you are stuck for creative juice in video gather up your friends. Ask your visually inspired friends to do it for you. It is on your computer, easy to use and produces a file you can upload almost anywhere.

Once you have that file you must upload it everywhere. I mean everywhere. You have to get on YouTube because you just have to. At the same time you can be sure that you will never be found there. The only views will be your friends, family and you (okay, sure a few stragglers will fall there). YouTube thrives on the traffic you bring them and you will get a few strangers that may fall into your material. However do not depend on this to be your key to world stardom or discovery. You must expand out and find places to be seen.

I always suggest that musicians put their creative efforts up at MusicTV http://www.MusicTV.com/share/ because they are a strictly niche music site. Here you upload your music video where they convert and host your material in FLV format. They give you code to put the video on your own site, blog or wherever at the same time as promoting you on a music only site. You put your own keyword tags and do not have to add "music video" or "Independent Music" and can focus on what your group is all about. You can select up to three categories, or genre, to display under and the search looks at tags and descriptions to provide results. The tags become relevant to search as well as the terms in your description.

You can put your music in a group and be found in groups. All of a sudden you pop up in a search! You get on the front page easier and you can be found. People are there for music and it is broken down to genre. Everything is fed with RSS feeds! That means all content is broadcast to all the important news consolidators on the Internet. It is a great starting point for any group.

The best feature for me is I can find and share all the new music on this site because the site is all legal. No one is allowed to upload "Madonna" video except Madonna. Rubi

Rubi is an ambitious young woman, who all her life wanted to become rich. She studies in a private university, where she meets sweet and rich Maribel, and becomes her friend. Rubi is the only friend of Maribel, who doesn't know that she wants to be her friend only because of her money. When Hector, a young and handsome architect with whom Maribel had been chatting on the Internet arrives at Mexico, Rubi meets his friend, Alejandro. Alejandro and Rubi immediately fall in love. Hector proposes to Maribel and she accepts. When Rubi finds out that Alejandro isn't rich as she thought, she decides to break up with him and do everything in order to marry rich Hector, and finally get the life she always dreamed of.
Customer Review: The edition is good, but the music is so boring.
The soap opera Rubi started so good, it was so quickly that in every episode you can see something exciting, unfortunately, with the huge succes of the soap opera Televisa ordered more episodes and there's when we had the problem, When we start to see the beginning of the end: the illness of Hector (then alejandro operates him but because of Rubi he let him die accidentaly). Instead of that, magically Hector gets healed, he gets a lover (Yadhira Carrillo), Rubi meet the Count (Manuel Landeta) and Alejandro have a lot of trouble in the hospital because of some fraudulent things. That part of the story is not as cool as the first episodes, they cut A LOT of secondary characters that actually their story wasn't interesting. That's why i think is a very good edition.... EXCEPT: For the music, the main theme (La descarada) was so goood, this new one is pathetic, and the score was also incredible, but especially the song from the dramatic moments. (In the special episode you can hear it in some of the dramatic moments, for example Sonia's death, when Rubi runs to the beach with her wedding dress, when Maribel watch Rubi at the airport with Hector, etc, etc. Instead of that good song they use a very boring theme, it doesn't transmitt the same emotion and tension. Hope we can see a new version of the dvd but with the real music and with more scenes and extras. By the way the extras are very cool, the finale of the original series in black and white, the special of rubi's niece, the press conference of Rubi, the only missed the original trailers (THEY'RE SO COOL, check them out on youtube)

Different individuals have various definitions of gospel music. For those who believe, gospel music is a blissful noise for the Lord. It has also been said that gospel music can stir different emotions with its lyrics and tunes; hence, there is an increasing number of gospel music audiences around the world.

But when did gospel music really start? According to some studies, the history of gospel music dates back to the 18th century. This was an era where hymns were usually lined and repeated in a call and response fashion. On the other hand, the spiritual and work songs of the African slaves came along. These slaves were prohibited from many things and were punished for offending their masters. Such situations did not hinder them from worshipping and learning to create their own worship hymns, however.

From 1900 through the 1930s, gospel music was attributed to the social changes in the United States where blacks from the South were moving to other areas of the country with their own gospel music. After this period, noted people who are attributed to gospel musics success came into the picture.

During the 30s, Thomas A. Dorsey was given credit for the crucial development of gospel music. He created songs combining shouts of praise and emotional fervor with his won contemporary style. This was mostly unwelcomed in churches. This era in the history of gospel music was named the Dorsey Era and Thomas Dorsey was named the Father of Contemporary Gospel Music.

During the 1940s, gospel ensembles and quartets sprang to life. These groups traveled all over the U.S., creating a demand for this type of music. On the other hand, the 50s brought the piano and the organ to gospel music. Some performers on this era were The Clara Ward Singers, The Staple Singers of Chicago, and Albertina Walker.

Nowadays, gospel music is still evolving. Many gospel music artists even believe that it is now coming into the mainstream and that they are to introduce gospel music to the mainstream audience.

Where music meets licensing, there's money to be made. How much money? "I have synched quite a few thousand songs into productions over the years," states Peter Jansson of Janssongs, Inc., "and have charged anywhere between US$1.00 and US$250,000 for each one."

That's correct: he said a quarter of a million dollars. And there are a great many places to earn money from music. For example, there are more TV shows on more cable channels than ever before. There are oodles of commercials. There are tons of electronic games and toys. There are corporate video productions galore. There are big movies, little movies, and direct-to-DVD movies. And they all are potential places to put your music, if the rights can be cleared.

Goldmine or Minefield.

The world of music clearance can be a goldmine or a minefield. We heard about the quarter-million-buck goldmine. "Having said that," Jansson adds, "I think an average fee is usually between $4,000 - $6,000 per side (i.e. Master & Synch). It depends on how badly they want to use the song and how big a hit it was." Those two words, "Master" and "Synch" indicate part of the problem for the average singer/songwriter who hopes to have a song appear on a soundtrack. Before you can start earning money, there's a lot to know.

The facts are so important that NARIP, the National Association of Record Industry Professionals, has Stacey Powells lead workshops on the topic. Powells, currently clearing music for On Air With Ryan Seacrest, says "This is a much more complex part of the business than most people realize, but it can be extremely lucrative for artists, so theres a great feeling to passing along this information."

A Little Tech Talk.

Music can be used in four broad categories under copyright law: Adaptation, Recording, Reproduction, and Public Performance. Depending on where and how someone is going to use a song, there are mechanical rights and synchronization rights that have to be negotiated, and the various parties involved may include the songwriter, publisher, and record company, usually holder of the master rights.

Well, that last part doesn't sound so complicated. Oh really? Consider that there may be multiple songwriters, each with their own publisher for their share of the song. Song copyrights are held by music publishers (which may be the artist, but more often is a third party), while sound recordings (the masters) are controlled by record companies (which also may be the artist, come to think of it).

The Facts of the Matter.

So what, exactly, is "Music Clearance"? Simple: getting permission from rights holders to use music in your production. But what rights? The song's copyright is held by the writers (or the estate of the artists, or whoever was sold the rights). The master recording is held by whoever controls the recorded version of the song. Ah, but which version of the song? The one the singer/songwriter recorded? The one recorded with Russian lyrics? The jazz instrumental? The one recorded by the metal-reggae band?

Consider this: you can get permission from the publisher without permission from the record company -- if you record a new version of the song. But without the publisher's permission, the master recording license does you no good at all.

The field is very competitive. Don Grierson, former head of A&R at Epic/Sony, Capitol Records, and EMI-America, and often a music supervisor, consultant, and executive producer, notes that "nearly everyone in the music industry seems to be aiming at the film/TV and commercial licensing markets. There is intense competition. It can come down to relationships on some occasions, but often it is determined by the ease with which you can obtain the clearance."

Negotiating the Fees

Janssongs' Peter Jansson quickly lists some of the variables: "When it comes to Synch Licensing, there are a number of factors that determine what the fee is going to be, such as: territory (USA? World? Provincial?), media (Theatrical only? Radio? Television? DVD/Video? New technology?), usage (Featured Instrumental/On Camera? Background Instrumental? Background/Vocal?), length (Entire composition? 30 seconds or part thereof?), version (re-record or original recording), to name just a few."

But even once you have sorted out who owns what and where something is going to be used, there's the legal terminology, with contracts likely to contain such phrases as "World excluding the BRT's," "Rear Window," "now known or hereafter devised," "MFN," "Pro Rata Share," "Third Party Payments," and even "Audit."

True, you don't need to know all of these things if you're a songwriter, recording artist, manager, agent, record executive, film/TV production professional, or advertising agency executive. But the more you know, the better. Not only will you be more comfortable with the business side of the music business, you'll be in a better position to guide a career -- your own or your clients' -- to more rewarding choices.

"Just knowing a little about these topics allows you to follow the conversations these clearance guys have with my clients and all their other representatives," says one manager of several musical acts. "And knowing a little can help a lot."

Real-life Examples.

Sometimes you learn by doing. "The very first time I licensed a song on my own," says Marc Ferrari of MasterSource Music Catalog, "I never got paid for the license. The production company released the movie (Son of Darkness 2) then went bankrupt. What a way to start a business!! I have had better luck with nearly 1,600 licenses since then!"

Don Grierson, when acting as a music supervisor for motion pictures, says "Those who represent songs often call me and ask 'What are you looking for?' and it's amazing how rapidly that can change. The music requirements for any given project, or even any given scene in a film, can change depending on the director, the producer, etc. And whatever mood is being established in the scene may change in postproduction, requiring a change in the music."

Mistakes to Avoid.

Where people are involved, there can be errors. "Publishing and record companies sell and sublease and assign rights, some of which they did not own to begin with," points out Janet Fisher of Goodnight Kiss Music. She quickly lists a few more potential problems: "New companies file new cue sheets and suddenly a song is attributed to the wrong writer, a title is changed, a publisher forgotten; or sometimes a copyright holder just stops filing all paper work, including change of address forms."

One indie artist who has had several compositions in TV shows says, "Being an indie artist can be a huge advantage. Music supervisors are always looking for quality master recordings. An indie artist can sign off on a master synch music license in a day. Time is always an issue, and TV supervisors love indie artists because of the lack of major label red tape which often leaves them without clearance in time."

Goodnight Kiss' Fisher agrees: "Obviously dealing with an indie catalogue is going to be more affordable, and easier to work with. The large entities are not as hungry as the small, and our songs are no more than once-removed from the source."

Another who agrees is music supervisor Frankie Pine, who has worked on all the Steven Soderbergh film and TV projects in the past decade. "I have had at least one indie recording in every film," she states, "and it is often much easier to get them to sign off on an agreement. In a business that is so time-intensive, that is a real plus."

Helping out indie musicians is Barry Coffing of Uprising Entertainment. "We go searching for great independent music," he notes, "and the great thing about this business is that there is so much excellent music being made in so many categories."

Musician vs. Music Supervisor.

Nancy Luca is a musician who plays so often on both coasts, she has an L.A. band, a New York band, and a Florida band, and does session guitar work (her solos were on two Heineken commercials during the Super Bowl broadcast). She observes that "There are people who make a lot of money writing music for television that 'sounds like' other artists. It would be great if they would use the real artists like me who have great songs but no break with a big label. I am for licensing just to let people hear the real music -- the stuff that was written with heart and mind, not just for a paycheck."

Joel C. High, Vice President of music and soundtracks for Lions Gate Entertainment, displays the excitement that many of us have for making music work with images. "We often have directors who are greatly inspired by music and who may be passionate about acquiring a song that wouldn't normally fit in the budget of that film or television project. That's when we, as music supervisors, have to try to bring that same fervor to the negotiating process. We try to go to bat for our filmmakers in such a way that it benefits the picture and gives the best possible exposure for the musical artist. We want to get the absolutely perfect music for the scene and often the only way that can happen is by getting the recording artist to see the merits of having their song in a film to consider the way their song is used so they will see benefits beyond just the financial one."

A Director of Copyright and Licensing at a major independent publishing company had this to say: "Obviously, licensing music in film/TV is a wonderful way to get exposure, although for new artists, it will probably not be lucrative. And of course, there are things writers/artists should take into consideration when someone requests to use their music: Avoid giving broad rights away for free! This sets a bad precedent in the community, especially for new artists/writers, and it de-values their work."

Did this person have any ideas for working out a compromise? Certainly: "If a writer is eager to be involved in a project, and the producer wants the use for FREE, here are a few suggestions when negotiating. First, try and reduce the terms (e.g. instead of perpetuity, reduce the term to 10 years; instead of all media, reduce to all TV or theatrical only; and instead of worldwide rights, try and reduce to U.S. only). If the producer is not agreeable to this, then the writer should request some sort of 'step deal.' Very little money (if any) is paid up front, but should the production be successful, they are obligated to compensate the writer at certain 'milestones'." The feeling is that "if the producer starts making money, so should the writers of the musical works involved."

Music supervisors Frankie Pine and P.J. Bloom have the best piece of advice for artists placing music: "When you get the call, say Thank You!" says Bloom. "There are so many people trying to get songs onto soundtracks, that it is important to get in the door and create a relationship."

The Bottom Line.

Fisher has a lovely metaphorical summary for this story: "Like any part of the music business, licensing can be feast or famine, goldmine or plain old shaft -- but like any part of any business, the best protection resides in employing those with experience and integrity. If I were looking for a goldmine, I'd find an experienced miner who had found gold before."
